Terms and conditions applicable to Enrollees


You must carefully go through the terms and conditions mentioned below and accept the same before enrolling yourself for any kind of certification awarded by Alza Management Institute.

By using this website you agree to be bound by these Terms, the General Terms & Conditions of www.alzains.com website and the Copyright Statement

The terms used in the agreement connotes the following meaning throughout the agreement:

  1. 'You' and 'Enrollee' refers to the individual or the firm enrolling for the certification program
  2. 'Institute', 'We', 'us' and 'AMI' s refers to Alza Management Institute
  3. 'The Website' refers to www.alzains.com
  4. Program: Program refers to all the programs and courses run by Alza Management Institute and the term 'services' shall be construed accordingly.
  5. 'Enroll' refers to the process of enrolling for a course and the term 'enrolment' shall be construed accordingly. When you enroll this will involve you completing the relevant application forms;
  6. Exam: Exam refers to all the exams, tests and quiz conducted by Alza Management Institute.
  7. Certifications: Certifications refer to all the certifications awarded by Alza Management Institute.
  8. Material: Material also refers to all the material and courseware supplied by Alza Management Institute. It also includes the questions, answers and other material supplied during the exams, tests and quiz conducted by Alza Management Institute.
  9. Logos: Logos refer to the logos granted by AMI after certification is awarded.

By clicking 'I accept' you accept that:

  1. Certifications: It is understood that certifications offered by Alza Management Institute are non-exclusive programs. It does not bind either you or the Institute under any kind of obligation or to act as an agent for the other. It also does not create any kind of employment relationship, joint venture, partnership firm or business entity of any other kind
  2. You
    1. Are responsible for your acts, behavior and omission and is no way related to the Institute.
    2. Must not violate the terms, conditions, rules, regulations and the policies of the Institute.
    3. Must not practice any kind of practices, which can be misleading, false, deceptive, unethical, illegal with regard to your participation in any programs run by the institute.
    4. Must obtain all the permissions, consents and authorizations, which are required to perform under and related to these rules.
    5. Must agree that the Institute retains all its right, title and interest in all and to its intellectual property and content material.
    6. Must work in a fair and workmanship like manner and adhere to all the rules and conditions listed by the Institute
    7. Must make it clear to your clients that under no circumstances you are employed, endorsed, recommended, contracted with the Institute.
    8. Must not have any criminal records or criminal cases pending against you in any court of law.
    9. Must not be connected to any underground/terror/ illegal element.
  3. It is also understood that the certifications are a privilege offered by the Institute. It is also understood that this privilege can be withdrawn or terminated by the Institute at any time without assigning any reason
  4. To register as a member of AMI you must be at least 18 years old. You agree that the information that you provide to us on registration and at all other times will be true, accurate, current and complete and you agree that you will ensure it is kept accurate and up to date at all times. We may refuse to accept your application to register as a member of AMI for any reason deemed right by us.
  5. When you register as a member of AMI you will be given or asked to select a user name and password. As you will be responsible for all activities that occur under your user name and password, you should take care to keep your user name and password confidential. You must notify us immediately of any unauthorized use of your user name or password or if you believe that your user name or password are no longer confidential. We reserve the right to require you to alter your username and password if we believe that they are no longer secure.
  6. For technical support we use reasonable skill and care in providing technical support and will use reasonable endeavors to ensure that this service is available but cannot guarantee uninterrupted availability. You acknowledge and accept that periods of downtime may be required in respect of the AMI IT infrastructure in the circumstances outlined in these Terms (dealing with unavailability of the Website) and that technical support may not be available during such periods of downtime. You accept that you will not have a claim for breach of contract (either against us or your AMI provider) or otherwise in respect of such period of unavailability
  7. Unless otherwise indicated, the content provided for the learners are the sole property of the Institute and in no way can be sold, published, or printed in any form in any media.

  9. The content provided would be for pedagogical purpose and the users should adhere to the rules related to the use of the content.
  10. The Institute may change or modify the rules at any time for any or no reason and without prior information.
  11. Everyone enrolling for the course must agree to comply with reasonable informational request that may be made by the Institute. The information supplied must be accurate, correct and full. Similarly, proper documents should be furnished as and when asked by the Institute.
  12. The certifications will be awarded at the sole discretion of the Institute. No statements of the person interested in getting the certification will be binding upon the Institute.
  13. The Institute will award the certifications on the ability of the person to satisfy the criteria laid down by the institute
  14. All the court expenses incurred by the Institute are to be reimbursed by the plaintiff.
  15. In case of receipt of any complaint, the Institute reserves a right to strip the enrollee of his certification.
  16. You can use the certification to as a proof of your talent but for no other purpose. The certification awarded to you will be personal, non-exclusive and non transferable. You till can use the certification terminated, provided that the AMI Certification requirements have not changed. AMI has the right to change the conditions associated with obtaining or maintaining AMI Certifications at any time.
  17. You are granted a non-exclusive, nontransferable, personal right to use the certification logos on your marketing collateral, resume, business cards, letterhead and website solely in connection with your provision of the Licensed Services. You are granted no other right, title, or license to the logos or any other AMI trademarks or logos.
  18. You should not use the logos for any illegal, unethical or immoral purpose.
  19. You agree not to interfere with or bring any kind of action or legal or administrative proceeding in relation to the rights and title of AMI or its certification logos.
  20. The maximum aggregate liability of the Institute for all claims, whether made in contract, tort under statute or otherwise (including in each case negligence) which are not otherwise excluded under these Terms ("Claims") shall be limited to the fees paid by the enrollee in respect of one incident or series of incidents arising from a common cause in each course duration commencing with the date that you became a member of the Institute.
  21. AMI website may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication services designed to enable you to communicate with the public at large or with a group (collectively, "Communication Facilities"), you agree to use the Communication Facilities only to post, send and receive messages and material that are proper and related to the particular Communication Service. For the avoidance of doubt, any comments or materials that you post on any area of the website are subject to this paragraph.
  22. AMI does not make any guarantee as to the availability, performance or continued provision of these facilities or services and reserves the right to modify or to terminate the provision of all or any of these facilities or services at any time. AMI also reserves the right to establish general rules and limits concerning use of its Communication Facilities. We shall notify you via these terms and conditions if we amend any such rules or limits.

    You agree that AMI have no responsibility or liability for the deletion or failure to store any messages or other communications that you send or receive using our Communication Facilities.

    You acknowledge that you are solely responsible for any content or other materials that you send or post to the Communication Facilities or any part of the Website and that AMI reserves the right to remove any message, which is inconsistent with our AMI of promoting an inclusive environment. By way of example, and not as a limitation, you agree that when using any Communication Facilities or services, you will not:
    • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others
    • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
    • Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
    • Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
    • Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.
    • Conduct or forward surveys, contests, pyramid schemes or chain letters.
    • Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
    • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
    • Restrict or inhibit any other user from using and enjoying the Communication Services.
    • Violate any code of conduct or other guidelines that may be applicable for any particular Communication Service.
    • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
    • Violate any applicable laws or regulations.

    AMI has no obligation to monitor the Communication Facilities. However, AMI reserves the right to review materials posted to a Communication Facilities and to remove any materials in its sole discretion. AMI reserves the right to terminate your access to any or all of the Communication Facilities or services at any time without notice for any reason whatsoever.

    AMI reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in AMI's sole discretion

    Always use caution when giving out any personally identifying information about yourself or your children in any Communication Facility. AMI does not control or endorse the content, messages or information found in any Communication Facility and, therefore, AMI specifically disclaims any liability with regard to the Communication Facilities and any actions resulting from your participation in any Communication Facility or service. Managers and hosts are not authorized AMI spokespersons, and their views do not necessarily reflect those of AMI.

    Materials uploaded to a Communication Facility may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

  23. In the event that you send any content that breaches the provisions of the above paragraph, AMI reserves its right to remove that content or disable access to it and to respond to any complaints made by a third party in respect of that content. AMI will not be liable to you if it removes any content because it believes that such content breaches the provisions of these Terms.

    AMI may also preserve any content that you send or receive if required to do so by law or if reasonably required to ensure compliance with the Terms or to respond to third party complaints about such content.

  24. AMI makes, and you receive, no warranties or conditions of any kind, express, implied or statutory, related to or arising in any way out of this agreement. AMI specifically disclaims any implied warranty for merchantability, fitness for a particular purpose and non-infringement of any third party rights. In no event shall AMI be liable for indirect, consequential or incidental damages (including damages for loss of profits, revenue, data or use) arising out of this agreement or incurred by any party, whether in an action in contract or tort, even if AMI has been advised of the possibility of such damages. AMI's liability ford damages hereunder shall in no event exceed the amount of fees actually paid to AMI under this agreement
    The exclusions and limitations of liability contained in this section do not apply to:
    • any loss or damage resulting from death or personal injury caused by our negligence;
    • loss or damages arising from our fraudulent misrepresentation; or
    • any other losses which may not be excluded or limited by law.

  25. These terms and conditions shall be construed as under and governed in accordance with the laws of Maharashtra, India. Institute and the user agree that the exclusive jurisdiction and venue of any lawsuit between them shall be a court sitting in Pune, Maharashtra, India.

    These Terms constitute the entire agreement between us in relation to the provision by us to you of the Services, and they replace and supersede any prior arrangements between us in relation to the Services. You acknowledge that you are not relying on any statement made by us or any of our representatives with regard to the Services other than those expressly set out in these Terms (which includes, for the avoidance of doubt, the description of the Services set out on the Website or provided to you in a AMI center). Nothing in this Paragraph shall exclude or restrict our liability for fraud or fraudulent misrepresentation.

    The continued use of the Website following any changes to the Terms will mean that you accept such changes.

    Each provision of this Paragraph shall be construed separately as between you and us. If any part is held by a court to be unreasonable, inapplicable or unenforceable, then the other parts shall still apply.
